Many believe that only the elite can create trusts. This is false! Not only wealthy individuals can create trusts, but ordinary people and women too. Private trusts are not covered by the Indian Trust Act 1882, also known as “The Act”.
Public Trusts are typically governed by state-specific legislation. Eg: Maharashtra Public Trust Act 1950. The Indian Trust Act covers all of India, except for the states of Jammu and Kashmir or Andaman and Nicobar Islands. This act does not apply to Waqf, charitable or religious endowments, and a few other entities.

Who can create/register trust?
- Any person competent to contract: This could include an individual, AOP or HUF, as well as a company.
- A Principal Civil Court of Original Jurisdiction must approve the creation of trusts on behalf or for minors.
How many types of trusts?
- Private Trusts: A private trust can be used to protect a small group. The beneficiaries can also be identified. Eg: A trust is created for the family and friends of the author.
- Public Trusts: A trust that is established for large groups, such as. The public at large. For example, Non-Profit NGO’s Charitable Institutions are for the general public.
Who can appointed as a trustee?
A trustee can be any person who is capable of managing property. A trustee is not required to take responsibility. The trustee must clearly state the purpose of the fund in words and actions.
Requirements to register a Trust Deed?
- Stamp paper trust deed with stamp duty
- Passport-sized photo and proof that you are a resident
- Two trustees must be able to show a passport-sized photo and proof that they are authentic.
- Two witnesses must be able to prove their identity and passport size
