What is the eligibility criteria for ESI Registration?

Non-seasonal factories or establishments with more than 10 employees (in few states, it is 20 employees), who earn a maximum of Rs 21,000 -/. The ESIC must be registered within 15 days of the date it was applied for.The employer must contribute 3.25% of the employee’s monthly salary, while the employee can contribute only 0.75 percent of his salary each month. Only employees whose salaries are less than Rs. 999 will be exempted from paying their contribution. 176/- per day.

What documents are required for ESIC Registration?

  • Registration Certificate obtained either under the: (Factories Act or Shops and Establishment Act.)
  • Certificate of incorporation of the establishment
  • Memorandum of Association and Articles of Association of the company.
  • Address proof. Any one of the following can be submitted as address proof (Utility bills (Electricity bill, gas connection bill or telephone bill of the establishment)
  • Rental agreement
  • Property tax receipts
  • List of all the employees working in the establishment.
  • PAN Card of the business establishment as well as all the employees working in the establishment.
  • The compensation details of all the employees.
  • Cancelled cheque of the bank account of the company.
  • List of directors of the company.
  • List of the shareholders of the company.
  • A register containing the attendance of the employees.

What entities are covered under ESIC?

  • Restaurants or hotels(engaged only in sales)
  • Shops
  • Cinemas
  • Newspaper establishments (which is not covered under the Factory Act)
  • Road motor transport establishments
  • Private educational institutions
  • Private medical institutions

What are the benefits of ESIC Registration?

  • Sickness benefits in the form of salary at a rate of 70% in the event of any diagnosed illness, which can last for up to 91 days per year.
  • An employee’s family member may be eligible for medical benefits.
  • Maternity benefits for women who are pregnant (paid leave).
  • In the event that the employee dies while working, 90% of his salary is paid to his family members in the form a monthly payment.
  • Same as above for employees who are disabled.
  • Funeral costs.
  • Costs for senior medical care.
