‘Patents’ are a type of intellectual property that allows the owner to prevent others from making, importing and using an invention. This is in exchange for publishing the invention for public disclosure. In other words, a patent is an exclusive right granted to an invention that generally offers a new way to do something or a technological solution to a problem. To secure a patent, a patent application must disclose technical information about the invention to the public.

What is the validity of the Patent Registration

The patent owner has the exclusive right to prohibit or restrict the commercial use by others of the patented invention. Patent protection is the inability to produce, use, transmit, manufacture, or sell the invention commercially without permission from the patent owner. The protection will be granted for a short period of time, typically 20 years from the date of filing.

Things to keep in mind while proceeding with patent registration

  • The First Schedule lists the fees applicable to patent applications and grants, as well as other fees that must be paid.
  • When applications for patents and other documents are filed in person, a 10% additional fee is charged.
  • You can pay the fees due under the Act, rules, in cash or electronically. Or you may send a bank draft or banker’s check. The amount is payable at the Controller of Patents. It is drawn on a bank that is scheduled to be in the location of the appropriate office. The fees will be considered to have been paid if the banker’s or draft cheque is sent via post.
  • The entire fee must be included in any document for which a fee is due.
  • If a natural individual transfers a request from another natural person to another natural person, the fee difference shall be paid by that applicant along with the request for transfer.
  • A small entity may request to transfer a partial or full application. The fee difference must be paid by the new applicant along with the request for transfer.
