Each state has its own Shop and Establishment Act (“Act”) The Act’s general provisions are however the same across all states. The Shop and Establishment Acts are regulated by the Labour Departments of the respective states. This Act governs all shops and commercial establishments within the state. Each state issues registrations under the Act. It may slightly vary from one state. The Act defines shops as places where goods are sold wholesale or retail, or where customers are served. This includes offices, godowns as well as storerooms and warehouses that are used in connection to trade or business.
A “commercial establishment“ is generally defined as an establishment that offers banking, trading, insurance, or other administrative services to persons who are working in office work. It can include a hotel, boarding house, eating house, restaurant or cafe, as well as other public entertainment and amusement places. The Act does not cover factories and industries. They are covered by the Factories Act 1948 and Industries (Development and Regulation Act 1951).

What is the process of obtaining Shop & Establishment Registration?
The proprietor of the shop/business must log in to the relevant State Labour Department website in order to obtain the online registration certificate. Owners or proprietors must complete the Shop and Establishment Act application form, upload required documents and pay the fees. The fees required for registration vary from one state to the next. After the registration form has been approved, the owner or proprietor of the business will receive the certificate online.The registration application must be completed and submitted along with the required fees to the Chief Inspector in the area to obtain the offline registration certificate. After confirming the accuracy of the application, the Chief Inspector will issue the registration certificates to the proprietor or owner.

Is shop and establishment act valid in all states & UT’s in india?
Yes, the Shop and Establishment Act is applicable to the entire country. Each state/UT has its own act, that governs entities within its state’s boundaries/area. The general provisions of every state’s act are however similar.
